PROBLEMS OF LEGAL PROTECTION OF THE LABOR RIGHTS OF WHISTLEBLOWERS IN UKRAINE: FROM THEORY TO PRACTICE

The theses is devoted to the study of the effectiveness of legal mechanisms for protecting the labor rights of whistleblowers of corruption in Ukraine. Based on the analysis of the court case of the Odessa Customs of the State Fiscal Service, it is demonstrated that the current guarantees have mainly an auxiliary function during a court appeal, but do not prevent pressure from the employer "at the moment". The author substantiates the need to expand the immunity of whistleblowers by granting the NACP the authority to suspend the effect of discriminatory orders with its regulations, shifting the burden of proof in court to the employer.
