STATE REGULATION OF LAND USE BY TERRITORIAL COMMUNITIES: LEGAL AND ECONOMIC ASPECTS

Abstract

The materials describe general issues of public regulation of land use by territorial communities, and reveal its legal and economic aspects. The general provisions of the law of communal ownership of land are defined. The issue of management and disposal of municipal property directly by territorial communities is considered. Attention on the procedure for demarcating state and municipal lands is focused. Separate provisions of current regulatory legal acts in the field of land distribution are analyzed. The legal, financial and economic problems related to land demarcation are listed. Statistical data on the number and cost of works on the demarcation of communal and state-owned lands are provided. Separately, it is noted about land valuation – a key and decisive component of the effective use of land resources of territorial communities. The implementation of the normative monetary valuation of land is emphasized and its relationship with the land tax rate is described. Statistical data on the amounts of revenues to local budgets from payment of fees for 2020 - January-February 2025 are provided. At the end of the theses, it is concluded that land in communal ownership is a major component of the resource base of territorial communities. Public regulation of the use of land by territorial communities is legally regulated, although there are certain issues that require clearer regulation. Several proposals to increase the level of local budgets by increasing revenues from land taxes are made.
