Abstract

The theses reveal the essence and content of the concepts of «municipal property» and «municipal ownership» as key categories of the institution of local self-government. It has been established that municipal property constitutes the material basis for the activities of territorial communities, ensuring their capacity to independently address local issues. An analysis of current Ukrainian legislation was carried out to determine the legal content of the category of «municipal property». Scientific approaches to interpreting this concept have been summarized, according to which it is considered from legal, economic, and managerial perspectives. It was found that in the scientific literature, municipal property is understood as a set of material and financial resources that ensure the economic independence of territorial communities. Particular attention has been paid to the relationship between the concepts of «municipal property» and «municipal ownership», and their interdependence and distinction within the legal framework have been identified. It is concluded that these concepts are closely related but not identical. It is emphasized that only in their unity can the real economic capacity of territorial communities and the functional independence of local self-government be ensured.
