PUBLIC SERVANTS’ PRIVACY IN THE LIGHT OF CORRUPTION PREVENTION: SEARCHING FOR BALANCE

The theses present an approach to the public officials’ privacy that differs somewhat from the generally accepted view, treating it as one of the factors contributing to successful corruption prevention. The issue of public officials’ limited privacy is analyzed from the perspective of one of the American leaders in the digital industry and a developer of artificial intelligence technologies, namely Palantir Technologies Inc. It is established that, despite the justifiably restricted right to respect for private life of people vested with public authority, ineffective protection of financial information about officials may expose them to the risk of becoming victims of profit-motivated violent offenses, as well as discourage honest and talented candidates from joining public service. Certain practical steps are proposed to regulate access for ordinary citizens to the Unified State Register of Declarations of Persons Authorized to Perform the Functions of the State and Local Self-Government. It is emphasized that the goals of corruption prevention should be balanced with the proper protection of sensitive personal information, which would contribute to staffing public administration institutions with qualified personnel.
