The theses presents a theoretical and methodological analysis of cross-border challenges arising from the transposition of Articles 15 and 17 of Directive (EU) 2019/790 into the national legislation of EU countries. It examines the rights of press publishers and the liability of online platforms. Legal fragmentation and its impact on the Digital Single Market are analyzed, as well as the phenomenon of «golden shielding» and its consequences for the integrity of the European legal space. It is argued that discrepancies in the implementation of the Directive create legal uncertainty and increase risks for business activities.
