THE CONCEPT OF RESTORATIVE JUSTICE: AN ASPECT OF COMMUNITY INTERACTION

The theses investigate the strategies of restorative justice within communities. Based on judicial practice of developed countries the author gradually analyzes a community aspect of restorative justice as an element of such strategies as mediation, conference, restorative community programs, reintegration, interview, justice rituals, social shaming and parental responsibility. It is emphasized that the common feature of all the strategies of restorative justice is a community intention to restore harm caused by an offender through their involving, along with a victim and a community itself, in a discussion of implications of the incident for the community in order to reach a restitution agreement. This analysis reveals that academic evaluation of the restorative justice strategies is rather positive because it proves the efficiency of restorative justice within communities.
