КОНЦЕПЦІЯ ВІДНОВНОГО ПРАВОСУДДЯ В АСПЕКТІ ГРОМАДСЬКОЇ ВЗАЄМОДІЇ

Тези розкривають стратегії реалізації концепції відновного правосуддя в аспекті громадської взаємодії. Досліджуючи, здебільшого, юридичну практику країн Заходу, автор послідовно аналізує громадський аспект відновного правосуддя як елемент стратегій медіації, конференції, відновлювальних програм громади, реінтеграції, інтерв’ювання, ритуалів правосуддя, соціального сорому та батьківської відповідальності. Наголошується, що загальною ознакою різних стратегій відновного правосуддя є прагнення громади відшкодувати шкоду, завдану правопорушником, шляхом залучення правопорушника, жертви та самої громади до обговорення наслідків правопорушення для громади та досягнення угоди про відшкодування. Проведений аналіз демонструє, що академічна оцінка практик відновного правосуддя в громадах країн Заходу є позитивною, адже доводить ефективність відновлювального правосуддя в громадах.
